Summary:
|
Pursuant to California Education Code § 17527(a), the District is authorized to “enter
into agreements to make vacant classrooms or other space in operating school buildings available for rent or lease to other school districts, educational agencies, except private educational institutions which maintain kindergarten or grades 1 to 12, inclusive, governmental units, nonprofit organizations, community agencies, professional agencies, commercial and noncommercial firms, corporations, partnerships, businesses, and individuals, including during normal school hours if the school is in session.”
The District owns and operates the Mt. Diablo Maintenance Yard, which is located at 1480 Gasoline Alley, Concord, CA 94520 (the "Site"). In 2012, District and T-Mobile's affiliate, MetroPCS California, LLC, entered into a License Agreement (the “Prior Agreement”), dated August 31, 2012, for MetroPCS’ use of the Site for a wireless telecommunications facility. In May 2016, MetroPCS "terminated" the Prior Agreement, yet MetroPCS remained on the Site.
This Joint Use Agreement and Lease (the "Agreement") settles T-Mobile's outstanding rent plus 10% interest, amounting to $359,651.98. In addition, in accordance Education Code §§ 17527, 17529 & 17531, the Agreement permits T-Mobile continued use of the Site for three years, in exchange for paying the District $3,406.51 per month for rent moving forward, with a 3% increase per year.
