Summary: On or about December 18, 2024, the Board of Education approved a Settlement Agreement in J.D. et al. v. Mt. Diablo Unified School District U.S. Dist. Ct., N.D. Cal., Case No. 3:24-cv-00908. The Settlement Agreement required the hiring of an independent third-party Title IX Consultant to oversee the implementation of the settlement terms. The Settlement Agreement requied that the The Title IX Consultant have the following level of experience: (i) at least five years of experience prosecuting Title IX athletics complaints for OCR, or (ii) serving for at least five years as a Title IX athletics coordinator for a public school district, or (iii) serving for at least five years in a similar capacity as a Title IX athletics consultant for one or more high schools as part of OCR and/or civil action settlement agreements. The Settlement Agreement required the parties to exchange names of proposed Title IX experts. The Parties mutually agreed upon Keasara Williams. This Agreement provides that: 1) The District will provide Quarterly Reports to the Title IX Consultant concerning its efforts and progress, from which the Title IX Consultant will opine whether the efforts comply with the Settlement Agreement and provide support and direction on any necessary changes; 2) The Title IX Consultant will conduct an annual in-person inspection of the facilities to determine compliance with the Settlement Agreement and provide support and direction on any necessary changes; and 3) The Title IX Consultant will also consider and opine upon complaints lodged by the Plaintiffs should they believe the District is in breach of the Settlement Agreement. The proposed outcome is that at the conclusion of this Agreement, the District’s Athletic Program at College Park High School will be fully in compliance with Title IX Athletic Requirements. The District will have a model of compliance to be implemented District-wide.
