Pursuant to California Public Contract Code § 20118, a school district may, without competitive bidding, authorize the purchase of materials, supplies, equipment, or services by utilizing a contract (“piggyback”) lawfully awarded by another public agency. This process promotes efficiency, saves time, and may result in cost savings by leveraging pre-competed agreements.
Twin Rivers Unified School District (TRUSD) issued a Contract and FERPA Agreement in August of 2023, used to procure services for EdPuzzle software. EdPuzzle is an instructional technology platform used for video-based learning and engagement.
Mt. Diablo Unified School District (MDUSD) staff proposes to utilize TRUSD’s contract with EdPuzzle through this piggyback provision. EdPuzzle has agreed to honor the pricing and terms extended to TRUSD for the 2024–2025 school year, providing MDUSD with access to the same software under equivalent contractual conditions.
District staff recommends that the Board determine that use of this piggyback contract is in the best interest of the District, as it complies with legal procurement requirements under PCC § 20118; Provides contractual documentation for us to complete the procurement process of software which was used by the District in the 2024/25 school year.
Ratify the District’s participation in the piggyback agreement with Twin Rivers USD for EdPuzzle software, for the 2024–2025 school year.
